Labor in Chicago

My friends parent company is based in New Jersey. But he works for a client in Chicago.
Can he file for labor in Chicago? Labor is NJ seems to take about 2 years.

Please advice.

he can file from chicago. But his project should continue until his 140 approves. It's as per my knowledge. Better to check with Attorney.

I am 100% postive that one can't file his/her case in a state where the filing company does not have a office.

Thanks for your input. My friend contacted his lawyer today and was told that he cannot apply labor in Chicago.
 
Your Attorney doesn't know 100%. I am telling the truth because two of my freinds did the same thing from chicago. Their company is located in Connecticut and they are working for Abbott.
 
pk_karim, How can my friend convince his attorney? His attorney is Sheila Murthy. If he can file in Chicago, that will be awesome. He can save lot of time. Any further info from you will be extremly helpfull.

pk_karim is right. It can be done. However I think no lawyer would like to take so much trouble and jeopardize his/her records in today's environment. DOL is issuing RFE on non-issues - who would like to take a chance?

i know one of my friends who filed labor from the state where he was working on project at that time. But his company is from different state. He got his GC last year without any problem.

He was on contracting job, so he kept on moving to the places where he gets project. But he kept the first address in that state from where he applied labor as permanent address for all purpose.

My employer is based in TX, I'm on a project in WA, My LC filed in NE SESA and forwarded to Chicago DOL. My employer has an office in NE.

GC is for future job. IF your company has office in Chicago, they can always argue that they wish to place you in Chicago office after you are a permanent resident...

Also, then it shouldn't matter that you were receiving pay
cheques from TX and state taxes were paid in TX.. correct?

But once you get your GC, you need to be working from the
NE office, in short getting pay cheques from NE office and
state taxes for NE should be paid.. correct?

Also, lets say the office opens up today and the company
goes ahead and files my GC, would that sound like fraud?
When the company intends to actively work from new
location, in short its not only for GC filing.
