Labor / I-140 Substitution

Hi All,

I got my LC approved. Subsequently I have filed my I-140. Now I have got an RFE on my I-140. During this process, due to financial crunch with my present employer, me & some of my colleagues have got the H1 Visa transfered to another company with the co-operation and assistance of the old employer.

Now as I have an RFE on my I-140, I'm not sure whether my old employer could get thru it. So this being the case can i use the
Substitution procedure with the new employer?

What substitution procedure?

There is no substitution procedure (unless the new employer is acquiring the original sponsor) that would permit a new employer to use the old employer's LC or I-140.
