My RIR conversion to PERM was denied. The lawyer has appealed the case (so they say). I need 8th year extn. Lawyer says that they will be able to file an H1 extn once the status of the case changes from denied to under review. Is this correct? shouln't I be eligible for an extension because I have filed for an appeal? Does USCIS give a letter that the case is under review?
Please help if you know.
Lawyer also says that they have not recieved any reason for denial. Is this possible?
You have the right to know the reason for denial . Ask firmly your employer/attorney to get the reason from CIS. Better not to work for companies who are not transparent.
