Labor Denied - 12/3/07

Hi,

My company had applied my labor on Sep 13th 2007. My attorney informed that she got a Audit query around Oct 20th, 2007. She replied back the query with all the advertisement information. I was regularly checking the website for the update. On 12/3/07, the status changed to "Denied". We were expecting for the notice from the Labor department. The following was the reason for the denial.

" The advertisement(s) placed in newspaper(s) of general circulation or in a professional journal do not contain the name of the employer "

The following was the advertisement placed and my employer had got many labors approved using the same format.

Prog. Analyst – State – Analyze, Design, develop, test & implement software applications using Java, J2EE, Struts, UML, XML, Weblogic, C, C++ & Oracle. Exp: Bachelor degree with 2 years relevant exp. Fax Number was given

Did anyone faced this kind of a issue. Please let me know. I spoke to my attorney, she wants to go for a new labor. Is it possible to fight back?

Looks like it got rejected on a technicality. Did the lawyer put everything together? If so, then she should have known about the name in the ad. This is not your fault from the sounds of things. Will you have to pay more money? Or is it just for the ads? It might be quicker and easier to just do a new PERM.

Thanks simsd, I have enquired with many persons and they have suggested me the same. I will be going for new labor in couple of months. Thank You!

Is the lawyer taking any responsibility and standing behind what they did? Are they charging you again?
