Labor clearance for H4

I'm on H4b visa.
My uncle is having his own business(SUB-WAY).
So my question is that COULD HE APPLY FOR MY LABOR CLEARANCE for initiating green card processing?

sure he can (as GC is for future job), but i doubt that it will be cleared because how can he prove that there are no eligible worker available here for that job.(since the job market is very weak now)
