Labor certification while on L1B

I am currently on L1B. My employer is planning to convert me to H1B as part of the 2004-2005 quota which will make my H1B effective date as 10/01/2004. I will be getting the H1B stamping done at India.

I have the following questions.

1. If my employer files LC right now while I am on L1B, will I have any problems with the LC after my status changes to H1B? Do I need a fresh LC after my status changes to H1B?

2. If LC is applied while I am on L1B, will my subsequent H1B be eligible for 7th year extension?

3. Is it better for me to apply LC under RIR or should I wait for PERM?

Answer : With a situation that is so close, it is not worth taking any risks and waiting, since PERM may not get passed, or even if it does, it may not help you in your particular case since there are many restrictions in how PERM was originally envisioned. Safest course is to start regular LC right away to ensure being able to file H1B extensions each year. Filing an LC can take 2 or 3 months even without running RIR advertisements, depending on various factors with your employer.
