My current company had applied for labor on August 2004 under RIR. And last year while I was still waiting for the labor certification, another company made me an offer and I was already at my last year of H1b. So the other company decided to file labor certification for my case under PERM. The idea behind this was, they would do PERM and I-140 and then I`d be able to make the move.
Anyways, they got the PERM approval for me, but I got promoted in my current company and I did not make the move. So, I stayed with the original company.
My question is this:
We filed I-140 with the current company on February-2007 and on May 28th we sent the premium processing fee. And on June 8th, it was still not processed. I`m not sure what is wrong but I started thinking, maybe we should not file premium processing since I had a PERM approval from another company and a labor approval from current company???
