Labor Certification Copy from Employer

Hello !

I am on the 6th year of my H1 Visa and I have applied
for Labor Certification 2 years back. It is filed in the state
of Maryland. I understand that for filing 7th year extension of H1, the receipt of labor cert filing will be useful. However, I am changing jobs now and will be doing the 7th year extension from a different company.

Do you guys normally get the labor certification receipts from your employers and do they give the receipt voluntarily. (I know of a friend of mine who got his labor certification receipt from his attorney who in turn got it from State Employment agency. )

You will be in trouble if they decide in the future not to support you and request a cancellation of petition.

In the entire GC process I-485 is the only application you have complete ownership. All others like ETA-750( Labor Certification ), I-140 ( Immigrant worker petition ) are owned by the employer/sponsor

Ask your current or going to be previous employer that you are in need of that Labor, either they can fax it to you or they can simply make copy of it. Even its their property, they will give you a copy of one, its the receipt that establishes yourself when you file 7th year extension. This is very crucial doc that you need to submit when applying for the extension. I got mine in one request to lawyer, not sure about how hard to get one.
