A little advice needed as to how to approach the Labor cert process. After masters in India, I worked for 3 ys in a subsidiary of an MNC in India and 2.5 yrs/H1 in US at the parent company as an employee.
My lawyer says the regular Ads in Newspapers process for LC wld not work as he can't use my work exp in the ads - because my first company was a subsidiary (even though in India) and the exp wld be treated as 'on-the-job' and same company as current.
Has anyone been in a similar predicament ? Is there any way to use my work exp? The first company is now taken over by some other co. How can I make my case unique if I can't use my experience? If I can't go through RIR, how should I tackle this in Non-RIR? How do new recruits go through Non-RIR process - is it possible ?
