Labor Application

Hi,

My company is in the process of filing Labor Application and I have some questions regarding the same.

I did my masters in US and joined this company 4 years back. I was with department A for 2 years and then moved to department B and have been with the new department for almost 2 years now. The job requirement for my current position says BS + 4 years.

According to my attorney BS + 4 years is equal to MS + 2 years BUT here is the biggest challenge. Since, I had gained my 2 years experience in department A of the same company, my attorney says that it is challenging to show the experience gained in the same company for which we are filing labor application eventhough the departments are different. At the same time he also says, if the jobs are dissimilar we can show that experience eventhough it was gained in the same company.

He has now given me two options:
1.Reduce the job requirement to BS + 2 years which is equal to MS + 0 OR
2.Show dissimilarities between the 2 positions held in the same company.

Not sure how to proceed on this. Any help is much appreciated. Thanks!!
