L2 Visa Transfer!!! (Please respond)

Hi,

I really appreciate if somebody provide answers to the following questions.

1) I'm currently on L2 visa (dependent of L1) expiring in next six months and I would like to transer my L2 visa to either F1(student) or H1-B visa so that I can remain stay in US.My husband will go back to India stay there for few months and will come back again either on L1 or H1 or H4 etc.,

a) Is this possible?

b) How easy it is to transfer L2 visa to F1 or H1-B(assume that one employer has agreed to apply for my H1B)?

c) To tranfer my visa, do I need to go back to India and get the stamping done in my passport?

a) Is this possible?

A=> COS is possible. To F1 you need to show clear evidence of non-immigrant intent. If in case you had already filed for LC, your chances are pretty slim in getting change of status to F1. To H1-B, you don't have much luck now (if you already didn't apply) as the cap is reached.

A=> To change status, you don't need to go outside US. But to get visa stamping under a different status than the existing one, you'd have to.
