L2 Visa - Eligibility for Dependent

I currently have a valid L1 petition. want to know if my "Step Son" will be eligible as a dependant. My spouse has a child out of her first marriage (Her ex-spouse is no longer alive)

She was remarried to me now. Can I take her Son as a L2 dependant.

Pls advice.

Your marriage took place before the child reached the age of 18

L2 visa for step child with visitation rights and passport with biological fathers name

I have a son (4 yrs old) from my wife's first marriage. The permanent custody of the child is with my wife and the biological father has visitation rights twice a month, though he has not visited even once since divorce which happend 2yrs ago. I attempted to adopt the child but the biological father denied his consent. Now I am getting sponsorship for L1 visa. Is my step son eligible for L2 Visa ? I am a software developer currently living and working in Bangalore, INDIA.
