Hi,
I'm in US on L1B and my wife has L2 visa. She works in a company now. Our L visas expire in June and currently we're in the process of extending them, together with her EAD card.
I'd like to understand what will happen if her company agrees to apply for H1B for her. If they submit the application now while we are in the process of extending the L visas, could this cause any complications and problems for the L visa extension (the eventual approval of the H1B will be next October)?
If she gets approved for H1B, she obviously loses her L2 status. Then if she gets laid-off and can't find another job and given I still have my L1B status, can she get back her L2 without problems?
Similarly, if she's not approved for H1B, can she still keep her L2 and work authorization?
And lastly, if she gets the H1B will she have the whole time allocated to H1B visas (3+3 years) or they subtract from that the time she has already spent on L2 visa.
I'll appreciate if someone knowledgable in these matters takes the time to answer.
