Can my wife go from L2 based EAD to 485 based EAD and go back to using L2 based EAD in order to stay on non-immigrant status.
Her L2 and the L2 based EAD expires end of this month. 485 based EAD expires end of 2007. Her L2 has been extended, but passport is not stamped. We have filed for extension of L2 based EAD, but it will not come before the current L2 based EAD expires.
If she continues to work beyond this month, does it automatically mean she is using the 485 based EAD, and her non-immigrant status goes away ?. Once her L2 based EAD extension gets approved, will it automatically bring her back to non-immigrant status. Or do we need to go out of the country and get another L2 visa and enter the country based on that.
