L2 Status if L1B returns to native country

Hi,

I would be leaving for US (from India) on L2 alongwith my wife(L1B). Our visa is stamped for one year and she is supposed to be there for a year as per current information.

It would be great if following queries could be answered.

Assuming we both have got all the papers stamped for 1 year stay in USA.

1 - If in any case my wife's company calls her back to India before 1 year say after 6 months, can I (L2) still stay in US till one year completion as I have all my papers and visa stamped for 1 year stay.
OR once L1B holder leaves US then L2 holder has also to leave irrespective of anything.

2 - When can L2 holder apply for SSN. Before applying for EAD or after getting EAD

3 - Which is faster. Applying for EAD online or submitting it by person at USCIS office

I'm not sure of your 1st question.

But for 2nd, you need to get your EAD on hand and then apply for SSN. In case of L2 visa holders, SSN is applicable only if you get a work permit.

Also these days there is no difference between applying online and doing it directly. Everything takes 45-90 days depending on which state you are in. So apply online, get an appointment for giving ur signature, foto and thump impression. Wait for min 45 days and you'll get your EAD card.

Once L1 returns home, L2 automatically looses status as it was based on dependent on primary visa (L1)... still check with Lawyer

You can apply for SSN as soon as you enter the country and have your I-94

3 - Which is faster. Applying for EAD online or submitting it by person at USCIS office

Online will go to SRC (Texas) its really fast...

Yeah...check with a lawyer on 1. If L-1 holders are traveling out of the US on temporary visits (should have evidence from company) for short periods of time, then L-2 may stay inside the US during this time.

However, if the L-1 holder is transferred back to the native country, then the L-2 holder has to leave the US too.
