L2 EAD Urgent

My L1 Visa expired on Jul 22. I applied for extension and got it til 2006

But my VISA still shows expired...I-94 was extended
With new rules I cannot stamp my VISA from US

I applied for EAD(e-filed) for my wife who is on L2

I got a notice saying that they want

1. I-94 copies
2. VISA
3. Marriage certificate.

Now our I-94 is extended but VISA has expired.
Will EAD be rejected ???

Visa is a travel document. You can use it to enter the country but not to stay here. It does not give you status.
A valid I-94 along with a BCIS approved status document are the documents that give legal status to you. So I don't think you have any thing to worry. Just send the latest approvals, extended i-94 and same visa copy...

One more question

1. As per EAD process, if I do not get my VISA in 90days I can apply for interim EAD.

In my case I applied for EAD on 26May. 90 days from that time will be August 26. But My case was put on hold as they needed some documents.

Can I still apply for interim EAD in August 26 ??

Can I apply for SSN based on Interim EAD ???

Just go to local office and see if they entertain interim EADs. I know for AOS (485) applications they stopped issuing EADs while application is on hold. If they give EAD, then you can get SSN. But call the SS Administation also ...
