L2 EAD to H1 Status

Hi, If a person is working on L2 EAD ( expires only by Nov 2005 ), can he apply for H1 B by April 1st 2005, and keep continuing to work till Oct 2005 with EAD card and then switch over to H1 when the FY 2006 starts ?!

Please help as this situation is very confusing.
 
Yeah by all means. I did the same thing. I started working on L2 and then swicthed to H1B.
Guess what you will get 6 more yearson H1B. time period on L2 would not be counted toward to H1b time.
