L2 + EAD that needs renewal - should apply to EAD with AOS?

Hi,

I am on L2 visa, working with EAD. The lawyer sent me forms to renew my EAD.

My case will be current in October and I am not sure what to do.

Should I apply for EAD with AOS? Should I renew with lawyer the existing one I have?
Can I do both?

Hi, I am in the same situation. My L2 Visa expires on November 1st. and my number will be current in October.

My lawyer told me that I can't adjust an expired status, so I need to go back to my country and renew my visa and once I'll get it I will send my AOS package.

I may be wrong, but as far as I know you can still apply for AOS on 1st October as your L2 is still current at that time. I expect by the middle of October you will receive an NOA from USCIS about the processing of your GC. This makes you legal (i think!) even once your L2 runs out on 1st November.

Alternatively, apply now for the L2 extension (and the L1 if necessary) and wait for the NOA to arrive for that, then apply for your GCs.

We are in the same position, but our L1+L2s expired 1st September this year, and DV number is current 1st October. We applied in July for extension to L1 and L2 visas. The L1 extension has already been approved but L2s will be another 3 months or so, but we are OK with having the NOAs for the extension applications. I visited my local USCIS office in Orlando on an Infopass to ask if this is OK and they confirmed we can do the GC application on that basis.
