L1B Visa - I-94 Issue

Hi

My current L1 Visa expires in Jan 2008. I came back to US last week after a India trip.My current I-94 Expires on Aug-2009.

I would like to go to India again in Feb 2008. My employer says they cant apply for L extension as I-94 does not expire in the next 6 months.

I would like to extend my current L visa. My employer suggests me to go to EWR port of entry to seek the modification of my I-94 so that it expires in Jan2008.

Can any of you know if I can to EWR airport immigration officer and request for modification I-94 to expire in Jan 2008.

Any help on this would be really great for me.

It looks like your L1B petition is valid till Aug 09 even though the visa stamp in passport expires in Jan 08. That is the reason the IO gave you an I-94 valid till Aug 09. If you go outside the US in Feb 08, all you need is a visa stamping in the passport to return back to the US and you may not need an extension of your petition.

Last time I got stamped in Canada with my current petition which is valid till aug'2009. But that time I have been given visa till Jan2008 as I entered US first in Jan2003. Do you think I can get stamping with the same petition.

I have total 320 vacation days in this period. Any idea on how to recaputure these days.

With L1B visa you can work only for 5 years at a stretch. Beyond that time, you need to be outside the US for one year before being eligible for another 5 years of stay in L1B status. If you are in L1A status, then that period is 7 years. Since you entered the country in 2003 presumably in L1B status, you can only stay in that status till 2008.

I know that it is possible to recapture the time spent outside when you are in H1 status, but I don't think that luxury is available to L1 visa holders.
