My husband is on L1B. He is a project Lead and has been working in the same company for the past 8 years.
1)Does he have the option of moving his visa to L1A? Is there any conditions that he has to meet for that?
2)We have applied for extension on his L1B. But they have given an RFE. Since there are many rejections on L1Bs where the RFE is sent, will it be ok to withdraw the extension and apply for a new L1A?
3)Our visa is getting over on 8th Jan'08 and I-94 a week after that. Will this affect our stay in US? If the status is still pending, can we do the shift from L1B to L1A?
4)I am on L2 with EAD. Can my employer do a GC for me? If so, is there a time frame that I need to be in US for them to start the processing?
5)Do I have an option of doing GC straight from L2 with EAD or should I change it to H1B and then do it? Will applying for GC from L2 speed up the process?
