L1B to L1A...can it be done?

Hello there,

My wife is currently under an L1B. When she came from Canada to the United States she was not considered a manager. She has since transfered to different cities within the United States and during that time, she has become a Manager of her department. Becuase of this new title, would she be allowed to move from a L1B to an L1A thus not going through the labor certification process? Can this be done and what are the steps that are required by her?

It can be done. Employer has to file an application with supporting documents such as promotion letter etc. Bascially it all depends on employer. Go ahead , ask employer to do so.

Once u have L1B converted to L1A, you can avoid Labor certification.

When you moved from L1B to A. How and where did you get your visa stamped, here in the US or you went back to India?

My case is similar, I shall appreciate your reply. Thanks in advance
