I am currently on L1B visa (L1B was issued for 3 years and I have my L1B visa till end of 2008.)

I came to the US just over a year back on a L1B visa for Company X. Company Y bought company X two months ago and I am now on a L1B transfer to Company Y (curently in process).

Company Z is willing to sponsor for a H1B for me this year in Oct 2007 quota.

1. Can Company Z apply for a H1B when my L1B is in process of transfer from Company X to Company Y? Since I have valid L1B visa stamp for company X, will I need stamping again now that company Y is sponsoring my L1B?

2. I need to go to India in June this year and how will my travel to India affect the process of H1B?

3. I want to stay on L1B as long as Company Y holds me and want to shift to H1B at any time when Company Y doesn't want me on their L1B? Is this possible

4. What is the best way to file for H1B considering my travel to India in june and to remain on L1B as long as I want to after returning to USA in July?

YES... you will not get COS (change of status)... its will be regular H1b approval

3. I want to stay on L1B as long as Company Y holds me and want to shift to H1B at any time when Company Y doesn't want me on their L1B? Is this possible

If you have H1B approved and not COS... you can wait till you want to join company Y ... go back to home country and get back after H1 staming... Ideally should not keep many months difference.... do it within 6 months of H1 approval

4. What is the best way to file for H1B considering my travel to India in june and to remain on L1B as long as I want to after returning to USA in July?

Regular H1 and not COS
