I am here on L1 visa valid till Feb 2006. I will have to leave India for my marriage on November. Another employer is sponsoring for H1-B. My questions are
1. If I apply H1 by change of status (COS), then can L1 and H1 can overlap for atleast 30
days? (i.e Can I give resignation after Oct 1, just to avoid being out of status)?
2. If I do change of status and go to India on November, will I get visa stamped. Because I heard saying you need at least 2 pay stubs from H1 employer. Is that correct?
3. If I avoid above two and apply for fresh H1 and can I go to Mexico for stamping say on Sept. If in case my H1 is rejected will I be able to enter in US with L1 stamping?
Can someone please help me in clearing my doubts?
