L1B to H1B Transfer Plz Help

Hello Guys,

I am currenly in L1b and i have planned to apply for my h1b for this year quoto. I was told after my h1b got approved i can continue working in H1b without going for stamping but I am planning to go back to India in June for my personal reason and coming back in july in l1b. On that case can i still work on h1b after Oct without getting stamped or should i go out of the country get stamped and come and work on h1b.

If your h1b with COS is approved before you leave to India in June, then you can start working on H1b without getting stamped. You can search and get an article about this in murthy.com but its not an official confirmation from USCIS. So you better talk to an attorney who knows immigration matters very well.

But if your H1B and COS is pending before you leave to India, then your COS is cancelled and you have to get your visa stamped in consulate.
