Mine is a very strnage problem. I came to US 2 months back. I was having exactly 2 months on my Visa when I was entering into US.
I got I-94 issued at the port of entry and everything went fine. Mine is L1B visa. and my Visa and petition are getting expired in a week from now.
But, my problem is, I've got I-94 directly for 3 years till 2008. I'm not sure if I've to say this as problem or not. As far as I knew, usually L1 visas will get I-94 only till the date of petition expiry date and we've to apply for extension for I-94 and petition together.
Now, because I've a valid I-94 with me, ppl are saying that I can't apply for petition extension. Hence, can't go back to India till 2008. If at all I want to go, I'll not be having valid petition in my hand. So, I've to file for a new petition.
I'm damn confused with my situation. Why all this happened ? Why did they give me I-94 directly for 3 years. And bcos of that I'm not able to apply for petition extension.
Now, my doubt is, Is there any way to apply for petition extension now by having this valid I-94 in hand so that when I go back to India I can go for restamping with this extended petition.
Please suggest me something on this problem.
