Hi,
I am working on L1B visa since April 2003. I have applied for H1-B through a Company A in the 2005 quota in september 2004 and got the approval in October 2004. Still I am working on L1-B visa. Am I eligible to start working on H1-B from January 2005 through Company B, if Company B files a H1-B transfer.
In Nut shell am I eligible to do a H1-B transfer from Company A to Company B without working through H1-B of Company A.

My H1-B approval date is october 6th, 2004. I am still working on L1B through my current company that I came with.

In order to do an H1b to H1b transfer you will be required to provide evidence that you were in a valid H1b status to begin with. That requires you to work for the H1b sponsoring employer (empoloyer A) before USCIS will entertain H1b transfer to employer B. At this time you don't seem to be in a valid H1 status since you are not working for your H1b sponsor employer A.

Your case will be considered as a fresh H1b, not as a transfer.
