I am working in US on L1A visa. Last year (2009) I applied for L1A to H1B COS thru different employer and got it. Unfortunately I couldnt join my H1B employer. So to avoid automatic change of status to H1B, I did leap frog and went out of US for a month. While leaving I returned my I-94 came with my H1B. When I came back in Oct 2009, I got new I-94 for my L1A visa.
Now I am planning to switch to my H1B employer. When checked my options for COS once again, I am provided with following suggestions. I request immigration attorneys to suggest how I can continue my work in H1B, without overriding (unknowingly) immigration rules.
1. Join H1B employer and start running payroll. Since I have my petition and I-94 from my L1A visa, no need to go out for stamping or once again apply for COS. Whenever I go out of country, I can get it stamped.
2. Apply for COS once again (PP) and get new I-94 once again.
3. Go out of country and get it stamped.
