Hi, Please help me with this situation.
My husband is on L1A which is expiring in nov. 2011 (will complete 7 years). I am on H1b. Can he change the status to H4 (based on my H1) in nov. 2011, then apply for fresh H1b next year 2012.
Or he will have to leave the country for 1 year and then only would be able to apply for fresh H1. Or If he stays on H4 for 1 year then only he could for apply for H1b. Would staying on h4 for 1 year count towards resetting his clock for H1b.
