L1A applying EB1-OR, being courted by another employer

I have been in USA under L1A for a few years and my company is sponsoring me under EB1-OR Executive/Manager. I expect the process to be completed around April this year. I am being courted to work for another company but do not want to jeapordise my GC app. If I wait until GC is approved, what happens if I move jobs shortly after?

The only alternative I can think is switch to H1B and then go under EB2 with sponorship from this other company. But that sounds like it would take years?

You could lose your GC status if you change jobs "too soon" but there is no consensus on what to soon is. Usually they say to take at least a year before switching

It seems like there are a couple of options for you. 1) apply for EB1EA, so you are not tied to an employer. 2) ask you new company to sponsor Eb1OR 3) apply EB2 NIW so you are not tied to an employer. EB2 can take years if you are from a retrogressed country, if you are not then it can be done quickly.

I think (1) is not an option as I don't think I would meet the criteria

For option (2) I am not sure how this would work. To be eligible my understanding is you have to have worked in executive/managerial position for the sponsoring company outside of the US for at least 1 year no?

EB2 NIW does not look likely either given my profession (financial services - I think we are currently viewed as the plague of the world!)

It there is any way to transfer sponsorhsip of EB1OR to new company without having to leave for a year that would be attractive

Being in business does not exclude you. Having benefit to the US economy is actually one of the criteia for being 'in the national interest'. Of course it would depend on what exactly you would do

Thanks Kariboo. The transfer of sponsorship would certainly be the easiest route if possible but have to say I've never heard of this before
