Hi,
I was granted a new company L1A visa in 2005 and recently applied for an extension prior to it's expiration.
To my surprise the extension was denied and I was given 30 days in which to appeal the decision. My I-94 has now expired but was current when the extension petition was filed.
I have now submitted the appeal and have to wait for the appeal process to complete.
According to the USCIS website this is currently taking 14 months!
Do I simply continue running my business in the meantime or am I now accruing "unlawful status"? I just want to be sure of my status during the time it takes for the appeal to be heard and dealt with.
Is there anyone out there that can answer my question?
