Hi all,

I hope someone can point me to the right direction, as I feel a bit lost.

My boyfriend is relocating to the US and I decided to join him. If we were a straight couple it would be much easier, but America doesn't recognise gay marriage yet.

I have been working for the same company since May 2006 as a Supervisor and they just opened offices in NY, so the opportunity for me to go is there.

I have been offered to go as a Assistant Manager, HR agreed, my boss agreed, everybody seems to be happy with the decision.

The problem is I quit studying before going to the University, therefore, I do not have a degree, in compensation I have 6 years experience in Customer Services, the last 3 as a Supervisor, I also speak Spanish, Portuguese to a native level and fluent English, not sure if that makes up to the fact that I don't have a degree…

For the above reasons I think I am not eligible for the H-1B Visa, and my company suggested to do a secondment from them UK office and then apply for the L1 Visa when I complete my first year with them.

I would like to know if the application for the L1 can be made before the completion of the year working in the company, so for when the year is completed, the visa is already processed. What I mean by this is, if I go with a secondment in February or March 2007, could the application for the visa be made at the same time, so when the secondment finishes in May, the Visa is already granted? May being when I complete my year with the company.

The reason why I can't wait until May to apply for the VISA is that they need someone there in March the latest and my boyfriend is also leaving in January.

Does anyone have any suggestion on how can I proceed? :confused: :confused:
