Hello,

I will be relocated as my company is opening a new office in the US.

1. What are the benefits of L1 visa versus H1B?

2. What are the backdraws of L1 visa versus H1B?

H1 - Visa will be valid for 3 years and it is subject to a cap of 6 years. After 6 years if your GC process is not initiated, then you have to stay 1 year out of the country to again get a H visa.

L1 - You can apply 140/485 right away. Labor certification is not needed, when you do your GC. But L1 visa'a are more scrutinized and now a days you get only one year of visa which has to be extended every year.

If you are on L1 and want to change it to H1 later, the H1 visa will be under the cap of 65,000. But if you are on H1 and wanna change company here in US, it is easy, since the H1 visa is not counted against the cap.

If you are married, then your spouse can get a work permit and work here if you are on L1 visa. This is not applicable if you are on H1, since your spouse will be on H4.
