I have a query regarding to L1 visa.
I am an Indian now working in U.K in a work permit visa at present.
I came to U.S.A in 2004 as a student (in F1 visa) completed my Masters and started to work as a structural engineer for a firm in Sept2006.
Unfortunately I did not make into the H1B quota for Masters in 2007 (since I had to wait till May 2nd, 2007 to get my degree certificate, and the quota had been exhausted by then). In Sept 2007, I was trasferred to one of our Company's branch office in U.K and I have been working there till now. I am planning to go back to my office in U.S.A. I would like to know if I would be eligible to go back in a L1 visa. I am aware that the immigration law states that an L1 applicant should have worked in an overseas office for at least one year(which I have) and should have 3 years of preceeding work experience with the same company. But I believe this 3 years is for an applicant with a Bachelor Degree. Since I have a total of 2 years experience with the same company and with a U.S Master degree I believe this 3 years could be waived (in special cases) as mentioned in the L1 immigration law.
Please advise me with this . I would highly appreciate your response and help in this regard.
