L1 Visa and Overstay in the Past

Hi;

I am planning to apply for L1 visa at the U.S. Consulate in Canada. I am a permanent resident and have been working for a company here for last 1 1/2 yrs. Now they want me to get L1 visa so I can travel to their office in U.S. My Company has Blanket L Petition approved so now I have to apply for L1 at U.S. Consulate. My concerns are that I have overstayed on my H1 visa in the past.

My H1 visa was valid till Jan. '97,I lost my job in July '96 but I stayed in U.S. until August '97. After I left U.S. in August '97 I got a new job offer from another company in U.S. and I got my H1 approved for 3 yrs and I entered in U.S. on my new H1 in Jan. '98 and worked for the company until Jan 2001, and left U.S. on time.

Does my past violation of visa terms make me ineligible for U.S. Visa? The 3 years/10 years bar applies in my situation?

Try to coantact an attorney. I overstayed while waiting for a L1 that was denied. My attorney said that as far as i did not stay more than 180 days (6 monts) there would not be a problem, but aas always it depends on the officer when you get here to the US.
When I overstayed, went back to my country, and cae back a few days after, applied for an L1 again and go it appoved. So it is possible, but my advice would be to contact an immigrationt attorney, it is the best spent money
