I need your kind help
to get some information on H1B visa. Currently i am on
a L1 visa and working for Company A. I am getting job offers from few
consultants who are ready to apply for a H1B visa. So
i have few queries in this context and would be really
grateful if you can help me understand that.

1. If my H1B is approved, do i need to quit my current
employer and must join the new employer after October
2008?

2. Even after my H1B is approved, can i still
disregard the consultant's job offer and continue
working on L1 status with my current employer? Can the consultant make me legally bound to work for him after Oct '08?

3. What is the difference between with COS and without
COS (Change of Status) while applying for a H1B Visa?

4. If i get a H1B visa, do i need to go out of US and
come back with a Visa Stamp on my passport with a
fresh i-94?

>> If you H1B was approved with a Change of Status (L1 to H1B) then you have to quit your current employer and join the new employer.

>> If H1B was not filed as Change of Status, you can ignore the consultant and continue with your current employer.

3. What is the difference between with COS and without
COS (Change of Status) while applying for a H1B Visa?

>> Change of Status is 2 application in 1. Please approve my H1B and change my status from L1 to H1.

4. If i get a H1B visa, do i need to go out of US and
come back with a Visa Stamp on my passport with a
fresh i-94?

>> If you get new I-94 with your H1B approval - it would mean that your case was filed as change of status. You do not need to go out and get a new stamp. If it comes without I-94, you will have to go out , get H1B stamped and come back if you plan to join the consultant.
 
Thanks for your reply. It's very much clear to me now but i have one more doubt.

1. Is there any advantage of filing an H1B either with or without COS. Some or the other benefit which is not clear here.Normally what people opt for provided that i am in US.

2.Is it my choice to apply with COS or it's my employers choice who is filing an H1B for me.
