Hi,
Please help me. My wife (working with 'A' employer in India) came into US in 2006 on H4. And then 'A' emp processed premium L1 for her. She worked on L1 for 9months and due to medical complications she was on loss of pay leave. In the mean time she got H1 approval in Oct, 2007 from new employer 'B'. But she wasn't working for any employer till date. Now last week she went to India for an emergency thinking that she could come back on H1 visa stamping provided 'B' employer gives her H1 documents. But 'B' employer fears of visa rejection as his company had bitter experience in India. 'B' said go ahead with the L1 visa stamping and come back to US and then enroll into H1.
1. Is this possible?
2. Is L1 still valid in this situation? He said as my wife did not work on H1 till date so L1 is still active. Is this true.
3. If my wife gets L1 visa stamped, after coming back to US, is she can work on H1 immediately or visa status change is required?
