L1 to H1 .. urgent

Hi,

My husband and I are on L1 and L2 EAD working for company A & B resp. My husband got H1 B approval with COS from company C . Since my husband wants to continue working for his earlier Co, We will be visiting India and reentering on L1 and L2 resp by end of this month.

-Can we both come back on L1/L2 visa (valid till dec 2008) so that we both can continue working ?

-If company A is filing COS for my husband from H1 to L1 again, does this mean the H1 B approvals are abandoned or can he start working on H1 on later date in the future ?

-If yes,How can he switch to H1 from L1 after few months ? Who will file COS ?

Please help us to find best possible way to continue working here in legal state without loosing H1 or we need to switch to H1/H4 to maintain his H1.

If his L-1 visa is still valid, chances are that he may be able to have L-1 status back, because he doesn't have an H-1B visa yet in his passport. But the safest way is for the Company A to change his status back to L-1 without any extension of stay requested.

His H-1B approval becomes invalid.

-If yes,How can he switch to H1 from L1 after few months ? Who will file COS ?

The COS should be filed by his H-1B employer

Unfortunately you won't be able to have both ways just because he wants to maintain H-1B. Its' either L-1/L-2 or H-1B/H-4.
