L1 to H1 transfer

Everyone,

My brother is working in US since december 2006 on L1 visa. He now want to transfer his L1 to H1 visa.

1. Can this transfer be possible at any time if company is willing to do his transfer?

2. What are the checklist to do transfer?

3. Whether he has to go back to the city of origin to stamp his visa after doing transfer? Are there any factors that tends him to go back to his prigin country and has to stay there for certain time and then only he can come to US on H1.

H1B transfer from L1 to H1b is absolutely possible next year if no initiative were taken sometime towards the end of december 07.

As for the check list, there isnt much of a famality. I think the company can easily provide you with those details that woud sponsor his h1b.


You do not have to go back to your country of origin to have your change of status effected.

so he can start his H1 process during any period of the yr or he has to do H1 only after April.I.e when normal H1B Quota starts.
