L1 to H1 status change

If a person is working on L1 and wants applies for H1 for a different company and after approval dooesnot get it Stamped on his passport for a year (which is the max period it can hold before h1 becomes invalid) then does he belong to that company in that one year period and does the INS change the status of the I94 (Issued for L1) into H1 once it's aproved
