L1 to H1 - resign from L1 employer before 1st Oct (H1 date)

Hi,

I am currently working on L1-B visa here in US which is valid till Oct-2009. My company is asking me to go back to India as the project has ended. But I have my H1-B already approved for another employer in US.

I am planning to resign on 31st Aug but my H1-B is valid starting 1st Oct only. Can I stay for month of September without any job here?

Is there any legal issues while in September?

Can there be any issues while going for H1-B stamping in India sometime in future?

There is no grace period for L1 holders to leave the country unlike H1 holders. Legally, you will have no status for one month.
 
Ask your current company that you need one month of vacation to spend here in US. (touring or personnel reasons)

Otherwise go to India and get your H1 stamping and come back.
