I work on L-1B since Feb 2007. Because I was in USA when my H-1B was filed (by different employer than L-1B), I have submitted my I -94 details. After H-1B filed in April 2008 I went to home country for month in May 2008 - june 2008. Since then have never gone out of USA. I got my H-1B approval in last week of september 2008. I got new I-94 with H-1B approval notice from my new employer. Because of the project (and some other contract problems with L-1B employer), I couldn't join the new employer on H-1B from OCT 1st 2008, now my project is finished on 20th oct 2008. I want to go back to home country and after getting H-1B stamped I want to resign L-1B employer.
FYI: Both (L-1B and H-1B) I-94s numbers are different because I have gone out of county in the middle of the H-1 process.
I am not sure whether my new employer has applied the change of status or not, when he made application for H-1B.
Question(s)
1. Which I-94 I should submit while leaving USA, the one (L-1B) I got on the port of entry OR the other one (H-1B) I got with approval notice OR BOTH ? Please explain with little more details whatever your answer is.
2. Is there any problem in the visa interview (for H-1B) for the period I have stayed in USA after OCT 1st 2008 ?
