L1 to H1 COS

Hi,

Me and my husband we both are in US for past 1 year and we both are on L1 visa. Now if want to move to a different company we have to apply for H1 that is in the month of April when the cap opens. But I also heard that we can apply for Change of Status from L1 to H1 directly without waiting for H1 cap to open in April. Is it possible? If yes how do we go about it?
Please advice.

NO... only if you have H1 transfer... its not subject to CAP. Incase of conversion as yours you are subject to CAP..... in that you have 2 options - COS or NON-COS
