Hi, I am currently on L1B visa and my visa has expired but my I94 is valid till Feb 2008. Now another company CompanyB is ready to file H1 in Apr 2007. My L1 project in CompanyA is till June 2006. But it might extend or might not extend. So I am confused whether to do a COS or just apply H1 to a Consulate in India. Can you please tell me what is the best option,
1) Can I do a COS and then if CompanyA sends me back to India in June 06, will I be able to get my H1 stamped in India and come back.
2) Can I do a COS and in case CompanyA keeps me till Oct 2006, Can I continue in CompanyA till I am comfortable to join CompanyB or Should I joing CompanyB from OCT.
3) Or just forget about COS and just get the petition approved and do a COS when I am ready to join CompanyB if I stay in US till Oct or If I go back to India get a stamping.
Can you please let me know. Did anyone face this kind of situation.
