L1 to H1(COS) Difficult Situation, Pl Help

My H1B petition was approved this week which had been applied through a consulting company B. Right now I am on an L1 visa and signed an agreement with my Current employer A (L1 Visa Holder) to give a 60 days notice period else I have to pay them approximately $9000. My H1 got approved late (got approved this week as there was a RFE) I don't have 60 days before 1st Oct 2008 to give a separation notice to my Current Employer A. Had my H1 been approved earlier I could have given 60 days notice to my current employer before starting to work on H1 from 1st Oct 2008.

In this case, can I continue to work on L1 legally for my employer A till Mid of November (60 days notice, notice given on 15 of Sept)? Should this be legal to continue on L1 after 1st Oct 2008 to follow my employer separation rule (60 days notice period). Please advise, how can I handle this situation?

Can someone Please respond. It's very urgent. Please share your experience in retaining the current Visa Status (L1, H4, F1…) by re-entering to USA on or after 1st October from Mexico or Canada . Thanks
