Hi Experts,
I am currently in USA on an L1-B visa, which I got extended on Aug 2006. My wife is on dependent L2 and working here in USA. I am applying for an H1-B visa both for myself and my wife in Apr 2007 Quota. We both are not doing a change of status (COS) now along with the H1-B processing. My questions are:
1. Can I join my new H1-B employer in Mar 2008 (and not in Oct' 2007) after getting my H1-B stamped in India?
2. After getting my H1-B approved in Oct 2007, if I change my mind and want to continue in L1 visa itself, Can I go back to India in Mar 2008 and get my L1 stamped? Will my H1-B petition be still valid? (i.e) Can I use the same H1-B petition later?
3. I am not applying a H4 for my wife along with my H1-B application (as I am applying a separate H1-B for her). So, if my wife's H1-B is not approved or processed. How can she change her visa from L2 to H4 when I change my L1 to H1-B?
