Iam currently in US on a L1 visa.
My husband is on F1 Visa with EAD. He will be working in a company
with this EAD until the H1B cap opens up.
I also have a valid F2 visa but entered US on the L1 visa. I had
gotten this F2 visa in Sep 2003 even before I had applied for L1. So
when I got my L1, the F2 visa was not cancelled and it is still valid
though I havent used it.
My husband has also obtained a new I-20 for myself for his EAD period.
My project might end in Jan or Feb and so I need to go back to my home country.
Is it better to apply for change of status here in US from L1 to F2 or
goback and come as F2 dependent using the dependent I-20 we have?
Can I still use the same F2 visa which is valid until 2006.
(which is unusead and more than an year old from the time I got it)
If I apply for change of status here, what happens ? Will they issue
a new I-94 instead of my current one ?
Any advice in this regard would be helpful.
