We had made the first L1 petition to have me come to US as President of a INC (Start Up) subsidiary of a Indian company. We initially started out as a virtual office & received a RFE about it, we upgraded to an office suite but our petition got denied as it said the upgrade wont be acceptable since the new agreement was dated after the original petition date.
We did not appeal & went in for a fresh petition under premium processing. We have received another RFE today with 3 objections -
1. The office is small & has a six month lease.
2. They want to know evidence of funds sent by parent company
3. They want to know how many employees the company would require in first year of operations.
Please advice keeping in view of the facts stated below -
1. The office is in a business centre, 200 sq ft $650 per month. The business centre does have common conference facility,common guest reception area. The lease is set up for automated renewal unless we give a 30 days notice. Besides this we recently have taken an apartment 1100 sq ft which will also be used as home office.
2. There are sufficient funds in the US company bank account to take care of 1 years operations,salary expenses. This funds came from commissions the we took in the US companys, this was done with the idea for building capital before we start expenditure in this US company. There are ver nominal funds wired from our Indian company to US subsidiary. Is the criteria to have the US company well funded? OR are they concerned about India to US funding to be important?
3. We have stated we should have 2 sales consultants within 1 year. the business plan gets a little ambitious after 1 year where we may require employees in double digits.
Please advice what to reply in the RFE.
