Me and my wife visited India, and returned separately. When I returned on Jul 4, INS gave me an I-94 only upto Jul 18 (my visa expiry date) rather than 21-Aug (L1 expiry date). My wife returned on Jul 30 and though she had the new Indefinite Blanket L for the company, INS gave her upto 21-Aug.
Since my extension was only filed on Jul 15, and it could take 8-12 weeks for it to get approved, my wife would need to leave the country by 21-Aug and wait for my approval notice.
Is there any way that her request for extension can be attached to the petition already submitted for me? We can't withdraw mine and resubmit since I would be out of status immediately. Would appreciate any perspective on this.
In addition to the possibility above, is there a way to apply in person at the Local INS office for a "temporary" extension of my wife's I-94 for about 2 months ? That way she would be able to stay till my approval notice arrives, and then we can file for her extension.
Any precedents like this ? Any suggestions ?
