L1-One Year rule out of US-Payroll Urgent

Hi,

I have been struggling to get answer on this for 2 months. Can anyone help.

if a person is going to an international assignment for 2 year for a Sister company of US (being still on US payroll and an employee of US firm ) Can he come back to US on L1 visa. (Assume US firm will terminate his H1-B file the moment employee will leave for international assignment)

OR

Does the person need to be on Sister company's payroll at international location to qualify for L1.

YES.... I do not see any reason why not

OR

Does the person need to be on Sister company's payroll at international location to qualify for L1.

YES it needs to be on the payroll internationally (official company in that country) ... it will act as evidence
