L1/L2 to H1 conversion

Hi

I am working in US on L2 EAD. Now my husband's company thru which we hold our L1/L2 is asking us to go back to INDIA. but we have already applied for H1 last year and both me and my husband's applications got approved. but as we applied for H1 from INDIA, we are told that we have to go back to INDIA for H1 to become effective.
Can I apply for change of status from L1/L2 to H1 from US or do I have to go back to INDIA for H1 visa?
Please let me know.

Does your H1 employer still have a job for you? You may apply for a change of status based on the old petition, but you and your employer have to prove that the job is legitimate and still existing.
 
I have not worked on H1 till now..I just got it approved but as I was working on L2 did not bother to change my status to H1. Now that my husband's company is asking us to go back, we want to move to H1.
The present job that I hold on L2 is a full time job. So, I want to take a client letter from the same client and produce that as employment and get my H1 stamped. but will they ask for any agreement or any other documentation between my H1 employer and my present client?
Once I get my H1 stamped, then I want to get 3 paystubs from my H1 employer and then apply for H1 transfer to my present client as they have a full time offer for me.

Is this scenario valid. Please suggest me.
